contract for major highway structural maintenance works covering the whole
of Devon. It is expected that the contract will be awarded to 3
contractors with a possible annual value of work to each contractor
exceeding £2m. Individual works orders issued under the contract are
likely to be between £250 000 and £1m, with some possibly over £1m in
value. The contract will run for 3 years from April 2009.

maintenance schemes include Preliminaries; Site Clearance; Drainage;
Earthworks; Pavements; Kerbs, Footways and Paved Areas; Traffic Signs and
Road Markings; Landscape and Ecology. The predominant type of work
involved is carriageway surfacing.
Estimated value excluding VAT: 18 000 000 GBP.

months: 36 (from the award of the contract).

Council has a policy to minimise waste and to this end applications that
are succinct and normally not more than twelve A4 size pages in length
will, all other criteria being equal, carry favour. Applications showing
relevant experience and giving names and addresses of the two previous
employers for this type of work, to whom reference may be made, together
with authority to seek a bankers reference should be sent to the address
in I.1 to arrive not later than noon on the 15.8.2008. The tender
documents will be issued electronically through the Devon Procurement
Portal www.devontenders.gov.uk. You may register your interest on this web

This authority will incorporate a 15 calendar day standstill period at the
point information on the award of the contract is communicated to
tenderers. This period allows unsuccessful tenderers to seek further
debriefing from the contracting authority before the contract is entered
into. Applicants have 2 working days from notification of the award
decision to request additional debriefing and that information has to be
provided a minimum of 3 working days before expiry of the standstill
period. Such additional information should be requested from the address
in point I.1. If an appeal regarding the award of a contract has not been
successfully resolved the (for Public Sector) Public Contracts Regulations
2006 (SI 2006 No 5) provide for aggrieved parties who have been harmed or
are at risk of harm by a breach of the rules to take action in the High
Court (England, Wales and Northern Ireland). Any such action must be
brought promptly (generally within 3 months). Where a contract has not
been entered into the court may order the setting aside of the award
decision or order the authority to amend any document and may award
damages. If the contract has been entered into the court may only award
damages.
