Description of these options: Companies wishing to be considered to be
invited to submit a tender must complete a written Pre Qualification
Questionnaire (PQQ). The questionnaire can be obtained by writing to the
Managing Director at West Mercia Supplies, Holsworth Park, Oxon Business
Park, Bicton Heath, Shrewsbury SY3 5HJ, United Kingdom, quoting reference
CS847. The PQQ responses received will be used to select a shortlist of
companies who will be invited to tender. Depending on the level of
response, the Contracting Authority reserves the right to undertake
supplementary stages of selection prior to the issue of formal invitations
to tender. One copy of the Pre Qualification Questionnaire must be
received in the Purchasing Office, West Mercia Supplies no later than
16:00 on 30.4.2008.
Conforming tenders to be submitted. Thereafter, variants may be offered
but the Contracting Authority does not bind itself to accept any variants.
In the event of the tender responses being inadequate in either the number
of bids received or the quality of bids received, or in the event of
significant changes in market conditions, the Contracting Authority will
move automatically to the Negotiated Procedure without a further Notice,
taking all purchasing actions as appropriate.
This framework agreement is for a period of up to 3 years. If a move to
the Negotiated Procedure is made the Consortium will continue to use the
Negotiated Procedure for a period of up to 3 years.
Companies selected to submit a tender should not assume that their
selection implies any recognition or acceptance of their suitability to
undertake the contract.
The submission of the PQQ, the tender or any supporting documentation by
e-mail will not be accepted by the Contracting Authority.
New companies or existing companies able to offer new distribution
services which meet the requirements of the Contracting Authority may, at
the discretion of the Contracting Authority, be included onto the
Framework Arrangement provided they meet the selection criteria set.
The Contracting Authority reserves the right not to award a contract or to
award to the successful tenderer(s) any option or mix of options it so
wishes.
II.3) DURATION OF THE CONTRACT OR TIME-LIMIT FOR COMPLETION: Starting:
1.6.2008. Completion: 30.5.2011.
SECTION III: LEGAL, ECONOMIC, FINANCIAL AND TECHNICAL INFORMATION
III.2) CONDITIONS FOR PARTICIPATION
III.2.1) Personal situation of economic operators, including requirements
relating to enrolment on professional or trade registers: Information and
formalities necessary for evaluating if requirements are met: Providers of
third party distribution services wishing to be considered for inclusion
in the tender process must first complete and return a Pre-Qualification
Questionnaire (PQQ) by the date in point IV 3.4. The questionnaire can be
obtained on request, by writing to the Managing Director, quoting
reference CS847. The information in the questionnaire shall form the basis
for the selection of suppliers to be invited to tender. Depending on the
level of response, the contracting authority reserves the right to
undertake subsequent stages of selection prior to the issue of a formal
invitation to tender.
Before awarding a contract, West Mercia Supplies may seek information as
detailed in Articles 45, 46, 47 and 48 of Directive 2004/18/EC and proof
that none of the circumstances detailed in Article 45 of that Directive
apply to tenderer.
III.2.2) Economic and financial capacity: Information and formalities
necessary for evaluating if requirements are met: A Pre-Qualification
Questionnaire detailing information required to be submitted with
expressions of interest can be requested from the person named at I.1.
These must be in writing on company letterhead (fax acceptable).
Minimum level(s) of standards possibly required: Companies wishing to be
considered for inclusion in the tendering process must first complete and
return a Pre-Qualification Questionnaire.

arrangements in place for the start of West Mercia Supplies' busy trading
period.
VI.4) PROCEDURES FOR APPEAL
VI.4.2) Lodging of appeals: Precise information on deadline(s) for
lodging appeals: The contracting authority incorporates a 10-calendar-day
standstill period at the point information on the award of the contract is
communicated to tenderers. This period allows unsuccessful tenderers to
seek further debriefing from the contracting authority before the contract
is entered into. Applicants have 2 working days from the notification of
the proposed award decision to request additional debriefing and that
information has to be provided a minimum of 3 working days before the
expiry of the standstill period. Such additional information should be
obtained from the contact and address set out in point I.1.
If an appeal regarding the award of a contract has not been successfully
resolved the Public Contracts Regulations 2006 (S1 2006 No 5) provide for
aggrieved parties who have been harmed or are at risk of harm by a breach
of the rule to take action in the High Court (England, Wales and Northern
Ireland). Any such action must be brought promptly (generally within 3
months). Where a contract has not been entered into the Court may order
the setting aside of the award decision or order the authority to amend
any document and may award damages. If the contract has been entered into,
the Court may only award damages. The purpose of the standstill period
referred to above is to allow parties to apply to the Courts to set aside
the award decision before the Court is entered into.
