1st That, the Ministry of Health is responsible for exercising the function that corresponds to the State of guaranteeing free and equal access to actions for the promotion, protection and recovery of health and rehabilitation of the sick person; as well as coordinating, controlling and, when appropriate, executing such actions. For its part, the San José Hospital is a Self-Managed Network Establishment, functionally decentralized, whose mission is to carry out the health actions that have been entrusted to it. 2nd That, in compliance with its functions indicated in the preceding numeral, and in attention to memorandum No. 131, dated May 16, 2024, the head of the Traumatology Service requests a call for public tender for the acquisition of knee endoprostheses for traumatology, accompanying for this purpose a list that indicates the description of the input, the quantities required, the technical specifications and the components of its standard configuration and the number of surgeries to be tendered. Said requirement was authorized by Provision No. 1205, dated May 16, 2024, of the Medical Subdirectorate and by Provision No. 1420, dated May 17, 2024, of the Administrative Subdirectorate. 3rd That, these supplies are not in the Electronic Catalog of Framework Agreements, available in the Public Procurement system, as reported by the Framework Agreement Consultation Certificate issued on October 10, 2024, by the Procurement Headquarters of the San José Hospital, in accordance with the provisions of article 14, fifth paragraph of the Regulations of Law No. 19,886. 4th That, in order to acquire said supplies, the establishment needs a management model that guarantees the availability and opportunity of said elements, also providing flexibility in their use. In this sense, the 'consignment system' will allow to control, regulate and order the acquisition and use of endoprosthesis supplies, in order to deal with the different types of fractures that patients may suffer and the wide variability of the size of the bones to be treated, in a faster and more efficient way. The aforementioned acquisition system will also guarantee the equality of the suppliers, the transparency of the process, the opportunity, quality and price of the supplies, as well as the protection of the fiscal patrimonial interest.
